Terms of Use

These terms govern access to and use of the graphmarks extension and its online features. Please read them before installing the product or creating an account.

Provider identification

In accordance with Article 10 of Spanish Law 34/2002 on information society services and electronic commerce, the provider of this service is Rubén García, Spanish tax number 79005724B, address at calle Txabarri 79, 3.º B, 48910 Sestao (Bizkaia, Spain), trading as Zetesis.

Purpose and acceptance

graphmarks is a browser extension that represents your bookmarks as an interactive graph and optionally offers online account and synchronisation features.

Installing or using the product constitutes acceptance of these terms as then in force. If you do not agree with them, you must not install or use it.

Licence to use

You are granted a personal, limited, revocable, non-exclusive and non-transferable licence to use graphmarks on supported browsers, subject to these terms and to the rules of the store from which it was installed.

This licence does not permit decompiling, reverse engineering, redistributing, reselling or creating derivative works of the product, except to the extent mandatory law allows.

User account

Local features require no account. Online features require one, and you are responsible for the accuracy of the details you provide and for safeguarding your credentials.

You must report any unauthorised use of your account without undue delay. You must be at least fourteen years old to register.

Acceptable use

  • Do not use the service to infringe third-party rights, distribute malicious software or carry out unlawful activities.
  • Do not attempt to access other accounts, systems or data, or circumvent technical security measures or usage limits.
  • Do not overload the infrastructure, automate requests abusively or resell the online service to third parties.
  • Breach of these rules entitles the provider to suspend access under the suspension and termination clause.

Your content

You retain all rights in the links, titles, notes and tags you add to your collections. No ownership of that content is acquired.

You authorise its processing solely to the extent technically necessary to store it, sync it across your devices and make it available to you. You are responsible for ensuring that the content you add infringes no third-party rights or applicable law.

Intellectual property

graphmarks, its source code, design, brand and associated materials belong to its owner or its licensors and are protected by intellectual and industrial property law. Using the product transfers no rights over them beyond the limited licence described above.

Availability and changes to the service

The service is provided as available from time to time. Corrections, improvements or modifications may be introduced, and features may be withdrawn on technical, legal or security grounds.

Online features may be interrupted by maintenance, incidents or external causes. Uninterrupted or error-free operation is not guaranteed. Where a material change affects a purchased feature, reasonable prior notice will be given and the conditions communicated at the time of purchase will also apply.

Pricing and subscriptions

Current status: the local features of graphmarks are provided free of charge and no checkout process is active yet. Any price shown for the sync plan is informational only and does not constitute a binding offer.

Once purchasing becomes available, the following rules will apply. Prices will be displayed inclusive of VAT. Subscriptions renew automatically for periods equal to the one purchased, unless cancelled before the renewal date. Cancellation may be requested at any time and takes effect at the end of the period already paid for, during which access is retained.

Non-payment or non-renewal does not entail the loss of your data: read access to and export of your collections remain available in line with the retention periods stated in the privacy policy.

Right of withdrawal and refunds

As a consumer you have fourteen calendar days from purchase to withdraw without giving any reason, under Article 102 of the Spanish consolidated Consumer Protection Act. To exercise this right, simply notify ruben@zetesis.xyz by any means providing a record of the communication.

If you expressly request that the service begin within that period and subsequently withdraw, you must pay an amount proportionate to the service already provided up to the time of notification, in accordance with Article 108(3) of that Act.

Outside the withdrawal period, no refunds are made for periods already started, unless the service has not been provided for reasons attributable to the provider. This is without prejudice to any remedies available to you for lack of conformity.

Suspension and termination

You may stop using and uninstall graphmarks at any time, and may request deletion of your account.

Access to online features may be suspended where there is a security risk, a serious breach of these terms or a legal obligation. Unless impossible or legally prevented, prior notice will be given and account data may be exported.

Warranties and liability

The service is provided with due care, without warranting fitness for purposes other than those described. Liability is accepted for damage that is a foreseeable consequence of a breach of these terms.

Nothing in this document excludes or limits liability for wilful misconduct, gross negligence or personal injury, nor the rights that consumer protection law grants consumers on a mandatory basis.

No liability is accepted for the loss of data held solely on your device, for which backups are your responsibility, nor for the operation of third-party browsers or stores.

Data protection

The processing of personal data arising from use of the product is governed by the privacy policy, which forms an integral part of these terms and is available on this website.

Governing law, complaints and jurisdiction

These terms are governed by Spanish law.

Any complaint may be addressed to ruben@zetesis.xyz and will be handled within one month. As a consumer resident in the European Union you may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

Where the user is a consumer, the courts of their place of residence shall have jurisdiction. In all other cases, the parties submit to the courts of Bilbao (Bizkaia), waiving any other jurisdiction.

Changes to these terms

These terms may be updated to reflect legal or product changes. Material changes affecting a purchased service will be communicated before they take effect, and you may terminate the contract if you do not accept them. The date shown above indicates the latest revision.
